A. USE OF SERVICE

APB - Advanced Parts & Brakes may, at any time, change, in whole or in part, these "Terms and Conditions", with the updated version always available on our website.

A “User” is any individual or institution who, in general, visits the content made available on the Website.

The User agrees to use this online product purchasing service from APB - Advanced Parts & Brakes in compliance with applicable legislation, as well as the "Terms and Conditions" stated herein.

Access to and use of the Website by the User implies acceptance of the Online Store Terms and Conditions and a commitment to comply with each and every one of the established terms and conditions. If you are using the Website on behalf of someone else or an institution, you confirm that the person or entity you represent also agrees to and will comply with these terms.

Nevertheless, APB - Advanced Parts & Brakes reserves the right to temporarily suspend access to the Website or certain areas or features without prior notice, particularly for maintenance reasons. APB - Advanced Parts & Brakes assumes no responsibility for any damages resulting from the inability, delay, suspension, or interruption of access to the Website due to technical failures or other reasons. It does not guarantee uninterrupted access or that technical issues will not occur.

Personal Data voluntarily provided by the User is subject to our Privacy Policy.

The User agrees to use the Website and the Content and Products offered on it appropriately and lawfully, in accordance with applicable laws. The User must refrain from:

Unauthorized or fraudulent use of the Website and/or Content for illegal purposes or effects, or accessing or attempting to access restricted areas of the Website without meeting the necessary conditions;
Introducing or spreading any form of malware or device that could cause changes to the Website’s or third parties’ systems.
The User guarantees that their activities on the Website will not, under any circumstances, damage the reputation or commercial image of APB - Advanced Parts & Brakes or any associated individuals or entities.

If the User fails to comply with any of these Terms and Conditions, APB - Advanced Parts & Brakes reserves the right to temporarily or permanently suspend the User’s access to the Website and cancel any orders.

The sale of products through the APB - Advanced Parts & Brakes Online Store is subject to compliance with Law No. 83/2017 of August 18, which establishes measures to combat money laundering and terrorist financing, partially transposing Directives 2015/849/EU and 2016/2258/EU, and amending the Penal Code and Industrial Property Code.

The Website contains texts, photos, graphics, logos, images, and works protected by copyright.

Online store Users/Customers may be:

Final Consumers, subject to VAT, except for residents outside the European Union;
Business Clients, properly identified and authorized to purchase specific products under previously agreed commercial terms.
Product deliveries comply with Portuguese laws on distance selling, as set out in Decree-Law No. 24/2014 of February 14, amended by Law No. 47/2014 of July 28 and Decree-Law No. 78/2018 of October 15.

B. ONLINE STORE REGISTRATION

User registration is done through the “Register” option and differs depending on whether the user is a Final Consumer or a Business Client.
Registration simplifies the purchase process by saving the user’s identification data, allowing for immediate recognition.
Customers can update their delivery information and Tax Identification Number in the customer area.
Access is restricted to each Customer and secured by a login and password.
If opted in, the registered user will receive marketing campaign information and newsletters via the provided email, with the option to unsubscribe at any time.
For Final Consumers:
a. The Taxpayer Number provided during registration will be automatically associated with the invoice issued after order processing. Customers can update their Tax Identification Number for billing purposes in the customer area whenever they make a purchase.

For Business Clients:
a. Once successfully registered, Business Clients are authorized to purchase products in the online store. If the business product catalog is not available, they should contact APB - Advanced Parts & Brakes at shop@apbshop.eu to begin the accreditation process.

b. The Tax Identification Number provided during registration will be automatically associated with the invoice and cannot be changed.

C. PRODUCTS IN THE ONLINE STORE

Products that are properly identified in the respective catalogs can be purchased in the online store.

Products intended for purchase by Business Clients have restricted access and can only be purchased by users who are properly registered and accredited.

The unavailability of a product in the online store does not necessarily mean that it is out of stock at APB - Advanced Parts & Brakes; it may be available through another company distribution channel.

Products available in the online store have limited stock and may become unavailable without prior notice.

In the event of a stockout after payment has been made, APB - Advanced Parts & Brakes reserves the right to refund the corresponding order amount. APB - Advanced Parts & Brakes will inform the customer and process the refund within 15 (fifteen) days from the date the customer provides their IBAN for the refund.

For PayPal payments, if no IBAN is provided, the refund will be made using the same payment method.

D. PRICES

The prices shown in the catalog are in Euros and include VAT at the legal rate in effect at the time of purchase, to which the respective shipping costs are added.

APB - Advanced Parts & Brakes reserves the right to change prices at any time.

The product price, VAT amount, and shipping costs are clearly itemized before the final purchase confirmation stage.

Only prices shown on an updated page should be considered valid; cached or outdated pages may display prices that are no longer in effect.

Any additional costs resulting from international shipping, such as customs clearance fees, are the sole responsibility of the product purchaser.

APB - Advanced Parts & Brakes informs that the prices available in the online store may differ from those practiced in the physical APB - Advanced Parts & Brakes store.

E. DISCOUNTS

The APB - Advanced Parts & Brakes Online Store may feature various promotional campaigns in the form of percentage discounts off the original retail price (PVP).

Promotional campaigns have a defined validity period, clearly indicated at the top of the campaign catalogs.

Placing a product in the shopping cart without completing the order does not guarantee the price or discount.

F. ORDERING

Ordering a product from the catalog is done by adding it to the shopping cart and completing the checkout process.

Purchases made in the online store are processed separately for Final Consumers and Business Clients, using distinct shopping carts.

Placing a product in the cart without completing the order does not guarantee its purchase.

For some products, clearly identified in the online store, purchases may be limited to a certain number of units per customer, depending on available stock.

Some products may require a minimum purchase quantity or be subject to other rules, which are clearly stated in the product details.

In the event of a confirmed delivery loss by the shipping service, APB - Advanced Parts & Brakes does not guarantee a replacement order due to stock availability. In such cases, a refund for the lost products will be issued.

The deadline for requesting clarification about deliveries is 30 days. After this period, no complaints related to orders will be accepted.

G. CANCELLATION, EXCHANGE, AND RETURN

The customer has the right to withdraw from the contract by returning the items in full and in good condition, without needing to state a reason, within 14 days from the delivery of the product. APB - Advanced Parts & Brakes will refund the full order amount.

An order can be canceled by filling out the form available on this platform. Once a registration number is assigned and the order is dispatched, the order details cannot be changed.

The cancellation request is only valid if the order number and customer name are correctly indicated in the form.

APB - Advanced Parts & Brakes reserves the right not to exchange products. Instead, the return and refund process will apply.

APB - Advanced Parts & Brakes will cover return shipping costs if the item is damaged or if there was a shipping error. In all other cases, return shipping costs are the responsibility of the customer.

The refund will only be processed after the returned products are received in good condition. The refund will be issued within 30 days of receipt.

Returned products must be complete and in good condition.

The refund will be made using the same payment method used for the purchase. If this is not possible, the customer will be asked to provide their IBAN for a bank transfer.

If a refund is requested, any used gift vouchers cannot be recovered.

If the order exceeds the purchase limit defined for a product, APB - Advanced Parts & Brakes reserves the right to cancel the order and refund the amount within 30 days.

Due to high demand on product launch days, stockouts may occur.

In the event of a stockout after payment, APB - Advanced Parts & Brakes reserves the right to refund the order amount. The customer will be informed, and the refund will be processed within 15 (fifteen) days from the date the customer provides their IBAN.

For PayPal payments, if no IBAN is provided, the refund will be made via PayPal.

It is not possible to change the selected pickup point after the order has been processed. In such cases, APB - Advanced Parts & Brakes reserves the right to cancel the sale and refund the amount within 30 days from the date the item is returned to the warehouse.

H. PAYMENT METHODS

Final Consumer

Products can be paid for using the various electronic payment methods available, with costs borne by the customer and charged on the sales document. Payment in the APB - Advanced Parts & Brakes online store can only be made via:

Bank Transfer
All orders placed in the online store must be paid within the specified period and using the selected method. If payment is not made within the deadline, the order will be automatically canceled and cannot be recovered.

Gift vouchers cannot be used to pay for shipping costs.

More than one gift voucher can be used in a single purchase, provided the total purchase amount exceeds the discount value.

If a refund is requested, any used gift vouchers cannot be recovered.

Accepted payment methods may be temporarily limited to PayPal, especially during high-demand periods.

This measure ensures immediate stock availability verification and faster, more efficient order processing, minimizing the need for later corrections.

While this may inconvenience customers who prefer other payment methods, it is necessary to maintain a high level of service.

Business Clients

Products can be paid for using the various electronic payment methods available, with costs borne by the customer and charged on the sales document. Payment in the APB - Advanced Parts & Brakes online store can be made via:

Bank Transfer
On credit after invoice issuance, according to previously agreed payment terms.
To ensure payment reliability, the selected payment method cannot be changed.

I. SHIPPING CONDITIONS AND DELIVERY TIME

Deliveries are made via DPD, CTT, or DHL and are handed over in person between 9:00 AM and 7:00 PM. If the first delivery attempt fails, the customer may request a second delivery. If no contact is made, the product is returned to APB.
Returns to APB are notified by email. The customer may reply to the provided email to request reshipment within a maximum of 6 months. After this period, the order is canceled and refunded.
Only three reshipments are allowed. After this limit, the order amount will be refunded.
The shipping tracking number is always sent to the registered email address at the time of dispatch.
The order is considered delivered once confirmed by the carrier on their respective website (dpd.pt, dhl.pt, or ctt.pt).
The deadline for requesting clarification about deliveries is 30 days. After this period, no complaints related to orders will be accepted.
Deliveries are not made to P.O. Boxes.
Orders are processed and shipped in the order they are received, with delivery expected within the indicated timeframes. It is not possible to schedule delivery times.
Delivery Timeframes:
Mainland Portugal
Standard shipping via DPD, CTT, or DHL: Shipping costs are calculated based on the weight of your order, with a minimum cost of €2.88 for orders from 0kg to 1kg. Delivery is typically within 7 to 10 business days after payment.
Madeira and Azores
Standard shipping via CTT: Shipping costs are calculated based on the weight of your order, with a minimum cost of €7.54 for orders from 0kg to 1kg. Delivery times vary between 7 to 10 business days depending on the island.
Rest of the World
Carriers vary depending on the destination country. Shipping costs are calculated based on the weight and destination during checkout. Delivery times vary by country.
Pickup Points
Orders are typically delivered within 7 to 10 business days after payment.
Important: The indicated timeframes are estimates based on order history. Delivery times may vary due to external factors such as holidays, weekends, festive seasons (e.g., Black Friday, Christmas, Easter), time zones, and customs regulations. Failed delivery attempts due to recipient absence may also cause delays.

10. Pickup Points

a. Available for the APB - Advanced Parts & Brakes store: São Paio de Oleiros location.

b. Orders are typically ready for pickup within 7 to 10 business days after payment.

c. This option exempts the order from shipping costs.

d. You will receive an email notifying you when your order is ready for pickup. You must present valid identification to collect it.

e. The pickup deadline is 30 days from the date of the availability notification email.

f. This option may not be available on product launch days.

g. It is not possible to change the selected pickup point after the order has been processed. In such cases, APB - Advanced Parts & Brakes reserves the right to cancel the sale and refund the amount within 30 days from the return to the warehouse.

h. By selecting the store pickup option, customers agree to verify the order contents on-site. Any issues must be reported immediately to the store staff or customer service.

J. COMPLAINTS

Customers have the right to file complaints with APB - Advanced Parts & Brakes at any time, within the legal parameters established for this purpose.

Complaints can be submitted via the “Suggestions” form on the website, by email to reclamacoes@abpshop.eu, or through the Electronic Complaints Book (https://www.livroreclamacoes.pt).

K. GIFT VOUCHERS

Gift vouchers correspond to 5% of the total sale value, excluding VAT, and are awarded for every €375 of accumulated purchases (excluding VAT).

The gift voucher is sent to the customer’s registered email and is available in the system for use in future purchases (online or in-store).

Each gift voucher is valid for a maximum of 12 months from the date of issue.

Active gift vouchers are automatically available at checkout. To redeem, simply select the vouchers you wish to use.

Gift vouchers cannot be used for:

Shipping costs
Multiple gift vouchers can be used in a single purchase, provided the total purchase amount exceeds the discount value.

If a refund is requested, any redeemed gift vouchers cannot be recovered.

L. NEWSLETTER

Newsletter subscription is available in the registration form and at the bottom of the homepage.

Newsletters include product launch information, promotions, campaigns, and offers sent to the subscriber’s email.

To unsubscribe, click the “Remove” option at the bottom of any newsletter.

M. PRIVACY AND SECURITY POLICY

APB - Advanced Parts & Brakes collects customers’ personal data for account management, billing, and information provision purposes, with express authorization. It is committed to privacy and data security in accordance with the General Data Protection Regulation (GDPR), Regulation (EU) 2016/679, as detailed on our website.

The entire payment process—from selecting the payment method to entering payment details—is protected through physical and logical procedures, as well as information security practices relevant to our operations.

N. APPLICABLE LAW AND JURISDICTION

These “Terms and Conditions” are governed by Portuguese law.

For the resolution of disputes arising from this contract, the competent court is the District Court of Aveiro, with express waiver of any other jurisdiction.
